Debate about the death penalty-lethal injection

I found this article from MSNBC site (http://www.msnbc.msn.com/id/22650019)

As you can see this article is about lethal injection, the one method of the death penalty. Kentucky death row inmate Ralph Baze, who was convicted of killing a Powell County sheriff and deputy say the three drugs used by Kentucky for execution are far too complex, and that they violate his constitutional right against cruel and unusual punishment. (the Bill of Right : Amendments to the Constitution 8)
Baze bring an suit about this to the U.S. Supreme Court.
and the Supreme Court review this problem now.

I think If the Supreme Court decide that Lethal Injection is violated The Right of Freedom From the cruel and unusual punishment, It means abolition of the death penalty without adopting less painful methods than lethal injection.
but In my experience, the death penalty is necessary to preventing crimes, social security etc.
